The Ministry of Pensions, who have beenI acquainted with Mr. Williams' views, agree that, wider section 11 of the Pensions Appeal Tribunals A et, 1943, a person to whom they have made an award under the Scheme has a statutory right to receive the sums payable under that award; but the proviso to that Section clearly states that this provision shall not affect any condition to which the award is subject, or any power of the Minister to vary or revoke the award or to withhold or reduce it in accordance with any provision of tie scheme. It is also true that a pension awarded to a widow under the Scheme is granted without regard to her income subject to the maintenance of the principle that there should not be double compensation in respect of the same contingency. Either of two articles of the scheve say operate in the latter connection. One of these provides that whers what le termed "other compensation" is pală în respect of the same contingency, either by way of periodical payments or by mous of a lump aum, the Minister can withhold or reduce the Schene award accordingly and the fact that the conditions attached to the award of the other compensation differ from those for awards under the Scheme, has no effect.
I hope that what I have said provides answers to the points raised by william to which I referred in my second paragraph, but I ought perhaps to emphasize that the conditions in the scheme operate generally, There is thus no discrimination against Ers. Tiason due to the fact that her husband lost his life overseas and there are, of course, no grounds upon which she could be treated more favourably than the widow of the civilian who, for example, was killed in an air-raid on the United Xingdom.
